VCAT Expert Leak Report Melbourne

1300 FINDLEAK provides an independent leak detection inspection and a written expert report prepared under VCAT Practice Note PNVCAT2 (Expert Evidence), for water leak disputes across metropolitan Melbourne. We test, find the source of the water, show where it is (your lot, common property or the neighbour's) and explain the evidence in a report you can file with the Tribunal. The fixed price is $1,198 inc. GST for one leak or area, the report is ready within 5 days of the inspection, and hearing attendance is available if it's needed.

VCAT says expert reports must reach the Tribunal at least 10 business days before the hearing, or they may not be accepted. If you already have a hearing or filing date, tell us when you book (there's a question for it) or call 1300 346 353 so we can schedule the inspection in time. Your report is ready within 5 days of the inspection.

What is a VCAT expert leak report?

It is a written report from an independent expert that helps the Tribunal decide a dispute about water damage. Unlike a standard leak report, it follows VCAT's expert evidence rules: the expert's duty is to the Tribunal, not to the person who pays for it. Ours covers the things VCAT asks for, including:

  • The expert's name, qualifications and why they're qualified to give the opinion
  • Confirmation that the expert has read PNVCAT2
  • Your instructions and the questions we were asked, quoted in full
  • Every fact, assumption and document the opinion relies on
  • Any relationship with the party paying for the report
  • The tests carried out, with readings, times and numbered photos
  • Where the water comes from, how it travels, and what it has damaged
  • Whether the source is within a lot, common property or an adjoining property
  • Recommended rectification and its limits
  • A summary of opinions, any limitations, and the signed declaration

The report states facts and expert opinion about the leak. Who is legally responsible is a question for the Tribunal.

Neighbour and unit-to-unit leaks

Water coming through your ceiling or wall from the unit above or next door. Under section 16 of the Water Act 1989 (Vic), claims about an unreasonable flow of water from another property are heard at VCAT, and the claimant has to link the damage to the source. Dye and flood tests show that link.

Owners corporation disputes

Is it the balcony membrane, a shower in one lot, the roof, a pipe in the slab or the façade? We test each path and say whether the source is in a lot or on common property, so owners and the owners corporation can resolve who acts.

Leaking showers, balconies, windows and roofs in new or renovated homes. We record what failed, the evidence for it, and the rectification needed, so the Tribunal, the builder and the owner are looking at the same facts.

Your questions become the report's instructions. We read the existing reports, photos and correspondence before we arrive.

Step 3

Inspection and testing

A senior technician runs a baseline thermal and moisture survey, then tests one zone at a time until the source is confirmed or ruled out.

Step 4

Signed expert report

Within 5 days of the inspection, you receive the report to file with VCAT and serve on the other parties. If evidence at the hearing is needed, we book the expert in.

Who orders a VCAT leak report?

Property owners and occupiers, neighbours and adjoining owners, owners corporations and strata managers, solicitors acting for a party, builders, and insurers or loss assessors. Any party to a VCAT case can arrange an expert report.

Independence: on expert report jobs we don't recommend or refer repair trades, and the fee is fixed before we start. The report says what the evidence shows, even when that isn't what the person paying for it hoped for. That is what makes it useful to the Tribunal.

VCAT expert leak report FAQs

How much does a VCAT expert leak report cost?

$1,198 inc. GST for one leak or affected area. That includes up to 2 hours of on-site testing and the signed expert report. Attending a hearing is optional: $798 for a half day by Zoom or $1,598 for a full day in person.

Do I need the expert to attend the VCAT hearing?

Usually not. Most VCAT matters are decided on the written report. If VCAT or another party asks for the expert to give evidence, we can attend by Zoom or in person, and our office confirms the booking with you.

Will the report say who is responsible for the leak?

The report says where the water is coming from, how it gets to the damage, and whether the source is within a lot, on common property or on an adjoining property. Who is legally responsible is a decision for the Tribunal.

When does VCAT need my expert report?

VCAT says expert reports must reach the Tribunal at least 10 business days before the hearing. Your signed report is ready within 5 days of the inspection, so tell us your deadline when you book and we'll schedule the inspection in time.

Is the report independent if I'm the one paying for it?

Yes. Under PNVCAT2 the expert's paramount duty is to the Tribunal, not to the party paying. Our fee is fixed and does not depend on the outcome, and we don't refer repair trades on these jobs.
